Understanding Trauma: A White Collar Perspective, by Basia Skudryzk

While the term trauma was originally largely confined to medicine and psychotherapy, it’s found its way into everyday language, where it is often used, semantically overstretched, for any form of painful or frustrating experience. Yes, even for the infamous word…Covid-19.

We have learned that trauma is not just an event that took place sometime in the past; it is also the imprint left by that experience on mind, brain, and body. This imprint has ongoing consequences for how the human organism manages to survive in the present. Trauma results in a fundamental reorganization of the way mind and brain manage perceptions. It changes not only how we think and what we think about, but also our very capacity to think.

Traumatic events encompass anything from a sexual assault or physical/mental abuse to a cancer diagnosis. “By abuse, we often mean things that are a lot milder than things people typically think of as abuse. It might include being hit with a hard object, like a whip, a belt, or a paddle,” says Roberts. “The behavior doesn’t necessarily need to be illegal to induce a traumatic response.”

People who experience traumatic events sometimes develop post-traumatic stress disorder (PTSD. PTSD can develop after a person experiences violence or the threat of violence, including sexual violence. It may affect people who have a close relative who experienced those things as well. These traumatic events are generally incidents that are considered outside the ordinary and are exceptional in their intensity.

Avoidance of painful intrusions as a measure of self-protection is only one of the reasons that makes it difficult to share a traumatic experience with others. There are many other reasons such as: speaking about what happened can be subject to interdiction, social taboo, or shame; a common ground of experience or knowledge is missing; one does not want to burden others with one’s own pain; the violation and the suffering have not yet been socially acknowledged.

“[A]nyone speaking or writing about concentration camps is still regarded as suspect; and if the speaker has resolutely returned to the world of the living, he himself is often assailed by doubts with regard to his own truthfulness, as though he had mistaken a nightmare for reality.” (Arendt 1951/1979: 439)

Our risk for mental and physical health problems from a past trauma goes up with the number of events we’ve experienced. For example, your risk for problems is much higher if you’ve had three or more negative experiences, called adverse childhood experiences (ACEs.. Adverse events include physical abuse, sexual abuse, emotional abuse, physical neglect, emotional neglect, witnessing domestic violence, substance misuse within the household, mental illness within the household, parental separation or divorce and incarceration of a household member.

While severely traumatic events are believed to have the greatest effect on long-term health, other stressful events that don’t necessarily meet the psychological definition of trauma can still cause problems. This might include a sudden death in the family, a stressful divorce, or caring for someone with a chronic or debilitating illness. These milder events might lead to a mental health disorder, such as anxiety or depression. Trauma pushes your ability to cope, so if you have a predisposition toward anxiety, for example, it may push you over the edge.

People who are suffering from traumatic memories may try to escape them by participating in risky behaviors such as drinking, smoking, drug use, compromising behavior for acceptance or even overeating for comfort. Coping mechanisms are used as a way of dealing with emotional disregulation that occurs when someone has been traumatized. These habits, in turn, lead to health problems. Experts believe that there is actually a direct biological effect that occurs when your body undergoes extreme stress. When you experience something anxiety-provoking, your stress response activates. Your body produces more adrenaline, your heart races, and your body primes itself to react. Someone who has experienced trauma may have stronger surges of adrenaline and experience them more often than someone who has not had the same history.

People who have experienced trauma may also struggle with getting help. One of the most common outcomes of trauma is avoidance. It makes sense. If you experience something traumatic, you want to avoid thinking about it and going to places that remind you of it. Some people may be in denial about the role past trauma is playing in their life. One of the hallmarks of trauma is the fact that people often use defense mechanisms to protect themselves from stress. Denial is one of those, as is trying to normalize past problems.

To get more information about trauma and PTSD or to find treatment resources, the following professional resources may be of use:

  • The International Society for Traumatic Stress Studies (www.istss.org)

  • The Anxiety and Depression Association of America (www.adaa.org)

  • The National Center for PTSD (www.ptsd.va.gov)

Taking steps to address the problem may also help others in your life. Very often people who have experienced trauma pass problems on to others in their family through a process called observational learning. So, helping yourself may help those around you. Consider these steps:

Work with a therapist. A trained therapist can help you reframe what happened to you and help you move past it. Exposure therapy is the idea of exposing yourself in small doses to the thing that was most traumatizing, with someone there to support you.

Take care of yourself. There are numerous lifestyle measures that can help you reduce stress and anxiety. These include yoga, swimming, walking, journaling and meditation. Regular exercise can also help you manage stress and other symptoms.

Reach out to others. Research has shown that maintaining strong social ties with friends and family members is crucial to good mental health. Become part of a support network.

People, organizations, and societies can emerge from crisis stronger. What good can come of this? In times of crisis, people often ask that question. This year we’ve been hit by a pandemic that has caused hundreds of thousands of deaths and a global economic downturn. In the face of such a tragedy, it might appear that the answer is “Nothing.”

EDUCATION: To move through trauma to growth, one must first get educated about what the former is: a disruption of core belief systems. For example, before the pandemic, many of us thought that we were safe from the types of diseases that endangered people in the past and that our social and economic systems were resilient enough to weather all storms. None of that was true. So now we need to figure out what to believe instead.

EMOTIONAL REGULATION: To do any learning, one must be in the right frame of mind. That starts with managing negative emotions such as anxiety and anger. Instead of focusing on failures, uncertainties and worst-case scenarios, try to recall successes, consider best-case possibilities and think reasonably about what you can do.

NARRATIVE DEVELOPMENT: The next step is to produce an authentic narrative about the trauma and our lives afterwards so that we can accept the chapters already written and imagine crafting the next ones in a meaningful way. Your story — and the stories of people you’re helping — can and should be about a traumatic past that leads to a better future.

SERVICE: People do better in the aftermath of trauma if they find work that benefits others — helping people close to them or victims of events similar to the ones they have endured. Identify with organizations that thrive under the leadership of people who have faced similar losses and want to share the strength they’ve gained. Focusing on how you can help provide relief during the continuing crisis — whether by sewing masks, retraining teammates, supporting small businesses or agreeing to a temporary pay cut — can lead to growth. So can simply expressing gratitude and showing compassion and empathy to others. Perhaps you can help those most seriously affected.

People are often surprised by how well they can handle trauma. They are left better equipped to tackle future challenges. Groups often come through such trials with a clearer picture of their collective knowledge, skills, resilience and growth potential. Trauma can also help forge new relationships and make people more grateful for the ones they already have. Coming through a crisis together is a bonding experience.

If you’re thinking this is all too optimistic, you may still be too close to the tragedy of this pandemic. So be patient as you work through and facilitate the process of post-traumatic growth. Growth can’t be forced, and it can’t be rushed. However, when you and others are ready, it is worth the effort. Let’s make sure that we derive something positive from this time of struggle.

Kelly is a tax attorney, business advisor and host of the Taxgirl Podcast. I reached out to Kelly after reading her column in Forbes about SBA PPP loans. She read my article on Entrepreneur.com (over 350,000 views folks!) on the same subject, and she invited me to be on her podcast. She followed up the podcast with another article in Forbes, As Law Enforcement Pursues SBA Loan Fraud, Jeff Grant Talks Redemption.

It was one of my favorite interviews ever. 

Today’s podcast continues our conversation, and broadens it to include good, solid business and tax strategies that small businesspeople can use to get through these distressing economic times. Kelly Phillips Erb: Years ago, I found myself sitting in law school in Moot Court wearing an oversized itchy blue suit. It was a horrible experience. In a desperate attempt to avoid anything like that in the future I enrolled in a tax course. I loved it. I signed up for another. Before I knew it, in addition to my J.D., I had an L.L.M. Taxation. I needed only to don my cape… Taxgirl® was born.

While at law school, I interned at the estate & gift attorney division of the Internal Revenue Service (IRS). At IRS, I participated in the review and audit of federal estate tax returns. At one audit, where I was the lead, opposing counsel read my report, looked at his file, and said, “Gentlemen, she’s exactly right.” I nearly fainted.

Today, I am a managing shareholder at The Erb Law Firm, P.C., where I focus on tax law including domestic and international estate and tax planning; tax compliance and controversy matters such as tax delinquencies, offers in compromise, and audits. I am licensed to practice in PA, NJ, and in the U.S. Tax Court. I am also permitted to practice law on a pro bono basis in NC through the Legal Aid of North Carolina.

In addition to my legal practice, I write extensively about tax. I am a Senior Contributor at Forbes where I write about tax and tax policy, including tax-related security & technology issues. I also have a regular column at Bloomberg Tax – you can catch my latest post here.

I’ve written and been interviewed about taxes for CNN Money, CNBC, Reuters, Time, and US News & World. I’ve also been asked to explain taxes in plain English by media outlets like National Public Radio’s Marketplace, Esquire, CBS Radio, Inc., Martha Stewart’s Living, and Marketwatch, and a number of podcasts.

What is the White Collar Justice Community?

Welcome to White Collar Week with Jeff Grant, a podcast serving the white collar justice community. It’s the isolation that destroys us. The solution is in community.

If you are interested in this podcast, then you are probably already a member of the white collar justice community – even if you don’t quite know it yet.  Our community is certainly made up of people being prosecuted, or who have already been prosecuted, for white collar crimes. But it is also made up of the spouses, children and families of those prosecuted for white collar crimes – these are the first victims of white collar crime. And the community also consists of the other victims, both direct and indirect, and those in the wider white collar ecosystem like friends, colleagues, prosecutors, defense attorneys, judges, law enforcement, academics, researchers. Investigators, mitigation experts, corrections officers, reentry professionals, mental health care professionals, drug and alcohol counselors, – and ministers, chaplains and advocates for criminal and social justice reform. The list goes on and on…

In this very eventful summer 2020, our mission is to introduce you to other members of the white collar justice community, to hear their very personal stories, and hopefully gain a broader perspective of what this is really all about. Maybe this will inspire some deeper thoughts and introspection? Maybe it will inspire some empathy and compassion for people you might otherwise resent or dismiss? And maybe it will help lift us all out of our own isolation and into community, so we can learn to live again in the sunshine of the spirit.

Along the way, I’ll share with you some of the things I’ve learned in my own journey from successful lawyer, to prescription opioid addict, white collar crime, suicide attempt, disbarment, destruction of my marriage, and the almost 14 months I served in a Federal prison. And also my recovery, love story I share with my wife Lynn Springer, after prison earning a Master of Divinity from Union Theological Seminary in NYC, pastoring in an inner city church in Bridgeport CT, and then co-founding with Lynn in Greenwich CT, Progressive Prison Ministries, the world’s first ministry serving the white collar justice community. It’s been quite a ride, but I firmly believe that the best is yet to come.

So I invite you to come along with me as we experience something new, and bold, and different this summer – a podcast that serves the entire white collar justice community. I hope you will join me.

Progressive Prison Ministries, Inc. is the world’s first ministry supporting the white collar justice community. Founded by husband and wife, Jeff Grant and Lynn Springer in Greenwich CT in 2012, we incorporated as a nonprofit in Connecticut in 2014, and received 501(c)(3) status in 2015.  Jeff has over three decades of experience in crisis management, business, law (former), reentry, recovery (clean & sober 17+ years), and executive and religious leadership. As Jeff was incarcerated for a white-collar crime he committed in 2001, he and Lynn have a first-hand perspective on the trials and tribulations that white-collar families have to endure as they navigate the criminal justice system and life beyond.

Progressive Prison Ministries, Inc. is nonsectarian, serving those of all faiths, or no faith whatsoever. To date we have helped over three hundred fifty (350) individuals, and their families, to accept responsibility for their actions and to acknowledge the pain they have caused to others.  In accordance with our commitment to restorative justice, we counsel our members to make amends as a first step in changing their lives and moving towards a new spiritual way of living centered on hope, care, compassion, tolerance, empathy and service to others. Our team has grown to over ten people, most with advanced degrees, all of whom are currently volunteering their time and resources.

Progressive Prison Ministries’ goal is to provide spiritual solutions and emotional support to those who are feeling alone, isolated, and hopeless. We have found that these individuals are suffering from a void but are stuck, and don’t know what to do about it. Our objective is to help them find a path to a healthy, spirit-filled place on the other side of what may seem like insurmountable problems. Many of those we counsel are in a place where their previous lives have come to an end due to their transgressions. In many cases their legal problems have led to divorce, estrangement from their children, families, friends and support communities, and loss of a career. The toll this takes on individuals and families is emotionally devastating. White-collar crimes are often precipitated by other issues in the offenders’ lives such as alcohol or drug abuse, and/or a physical or mental illness that lead to financial issues that overwhelms their ability to be present for themselves and their families and cause poor decision making. We recognize that life often presents us with such circumstances, sometimes which lead us to make mistakes in violation of the law.

All conversations and communications between our ordained ministry, and licensed clinical relationships, and those we serve fall under state privilege laws. This is one reason that attorneys often allow and encourage their clients to maintain relationships with us while in active prosecution or litigation situations.

Our guests are on the forefront of reimagining our criminal justice system at a critical time in our nation’s history – when a pandemic, social unrest, a Presidential election, and the media all call for rapid responses to very complicated issues. Issues that each have dedicated their life’s work to researching and teaching.

Dr. Jay P. Kennedy is an assistant professor jointly appointed to the School of Criminal Justice and the Center for Anti-Counterfeiting and Product Protection. He is also a Faculty Affiliate with the Michigan State University Graduate School, and Affiliated Faculty with the Institute for Public Policy and Social Research and the Center for Business and Social Analytics. Dr. Kennedy is actively involved in research, education, and outreach efforts that focus on external partners including corporations, industry associations, and law enforcement agencies. His current research explores managerial and organizational responses to employee theft within small and medium enterprises, the incarceration and post-incarceration experiences of white-collar offenders, the sale of counterfeit goods on the Internet, and the structure of occupational pharmaceutical counterfeiting schemes. Dr. Kennedy’s work has been published in a number of outlets, including American Behavioral Scientist, Criminal Justice Review, Journal of Crime and Justice, Journal of Financial Crime, Security Journal, and Victims and Offenders. He is currently serving as an elected board member of the American Society of Criminology’s Division of White-Collar and Corporate Crime and is an editorial board member of the Journal of White-Collar and Corporate Crime and the International Journal of Cybercrime Intelligence and Cybersecurity. Cathryn Lavery, MS, MA PhD, received her PhD in Criminal Justice from the Graduate Center/City University of New York with a specialization in Forensic Psychology and Ethics. Dr. Lavery is an active trainer, educator, researcher and consultant. She has trained on a variety of topics including: program curriculum and policy development, leadership training, sexual harassment, behavioral and mental health. She has coordinated and executed numerous conferences and seminars for multiple agencies in areas of sexual harassment, recruitment and retention and security threat assessment. She has worked within public educational settings, law enforcement and correctional agencies. Areas of expertise and consulting include: socio-political risk management, criminal justice and public administration issues, assessment and program evaluation, leadership development, sexual harassment and policy development, cultural sensitivity and intergenerational challenges within public and private agencies. After previously working at John Jay College/CUNY, Sacred Heart University and Iona College, where she was Chair and Graduate Coordinator for over  8 years, Dr. Cathryn has recently accepted the position of Chair of the Criminal Justice Department at Pace University. Erin Harbinson is a Research Scholar for the Robina Institute of Criminal Law and Criminal Justice at the University of Minnesota Law School, where she works on research projects studying probation and parole. She received her PhD in criminal justice from the University of Cincinnati. Dr. Harbinson’s dissertation examined the predictive validity of a correctional risk and needs assessment for people convicted of white-collar crimes. Prior to joining the Robina Institute, she worked as a policy analyst for the Council of State Governments Justice Center by providing technical assistance to states implementing justice reinvestment legislation and data driven policies. Dr. Harbinson has experience evaluating correctional programs and conducting training for correctional staff on risk assessment and other evidence-based practices in corrections. Her research interests include corrections policy, community supervision, parole decision-making, and understanding how corrections can reduce recidivism among people convicted of white-collar crimes and cybercrimes. Welcome to White Collar Week with Jeff Grant, a podcast serving the white collar justice community. It’s the isolation that destroys us. The solution is in community.

If you are interested in this podcast, then you are probably already a member of the white collar justice community – even if you don’t quite know it yet.  Our community is certainly made up of people being prosecuted, or who have already been prosecuted, for white collar crimes. But it is also made up of the spouses, children and families of those prosecuted for white collar crimes – these are the first victims of white collar crime. And the community also consists of the other victims, both direct and indirect, and those in the wider white collar ecosystem like friends, colleagues, prosecutors, defense attorneys, judges, law enforcement, academics, researchers. Investigators, mitigation experts, corrections officers, reentry professionals, mental health care professionals, drug and alcohol counselors, – and ministers, chaplains and advocates for criminal and social justice reform. The list goes on and on…

In this very eventful summer 2020, our mission is to introduce you to other members of the white collar justice community, to hear their very personal stories, and hopefully gain a broader perspective of what this is really all about. Maybe this will inspire some deeper thoughts and introspection? Maybe it will inspire some empathy and compassion for people you might otherwise resent or dismiss? And maybe it will help lift us all out of our own isolation and into community, so we can learn to live again in the sunshine of the spirit.

Along the way, I’ll share with you some of the things I’ve learned in my own journey from successful lawyer, to prescription opioid addict, white collar crime, suicide attempt, disbarment, destruction of my marriage, and the almost 14 months I served in a Federal prison. And also my recovery, love story I share with my wife Lynn Springer, after prison earning a Master of Divinity from Union Theological Seminary in NYC, pastoring in an inner city church in Bridgeport CT, and then co-founding with Lynn in Greenwich CT, Progressive Prison Ministries, the world’s first ministry serving the white collar justice community. It’s been quite a ride, but I firmly believe that the best is yet to come.

So I invite you to come along with me as we experience something new, and bold, and different this summer – a podcast that serves the entire white collar justice community. I hope you will join me.

Founded by husband and wife, Jeff Grant and Lynn Springer in Greenwich CT in 2012, we incorporated as a nonprofit in Connecticut in 2014, and received 501(c)(3) status in 2015.  Jeff has over three decades of experience in crisis management, business, law (former), reentry, recovery (clean & sober 17+ years), and executive and religious leadership. As Jeff was incarcerated for a white-collar crime he committed in 2001, he and Lynn have a first-hand perspective on the trials and tribulations that white-collar families have to endure as they navigate the criminal justice system and life beyond.

Progressive Prison Ministries, Inc. is nonsectarian, serving those of all faiths, or no faith whatsoever. To date we have helped over three hundred fifty (350) individuals, and their families, to accept responsibility for their actions and to acknowledge the pain they have caused to others.  In accordance with our commitment to restorative justice, we counsel our members to make amends as a first step in changing their lives and moving towards a new spiritual way of living centered on hope, care, compassion, tolerance, empathy and service to others. Our team has grown to over ten people, most with advanced degrees, all of whom are currently volunteering their time and resources.

Progressive Prison Ministries’ goal is to provide spiritual solutions and emotional support to those who are feeling alone, isolated, and hopeless. We have found that these individuals are suffering from a void but are stuck, and don’t know what to do about it. Our objective is to help them find a path to a healthy, spirit-filled place on the other side of what may seem like insurmountable problems. Many of those we counsel are in a place where their previous lives have come to an end due to their transgressions. In many cases their legal problems have led to divorce, estrangement from their children, families, friends and support communities, and loss of a career. The toll this takes on individuals and families is emotionally devastating. White-collar crimes are often precipitated by other issues in the offenders’ lives such as alcohol or drug abuse, and/or a physical or mental illness that lead to financial issues that overwhelms their ability to be present for themselves and their families and cause poor decision making. We recognize that life often presents us with such circumstances, sometimes which lead us to make mistakes in violation of the law.

All conversations and communications between our ordained ministry, and licensed clinical relationships, and those we serve fall under state privilege laws. This is one reason that attorneys often allow and encourage their clients to maintain relationships with us while in active prosecution or litigation situations.

Today on the podcast we have Tom Hardin, best known in the financial and legal worlds as “Tipper-X”.

Tom previously spent much of his career as a hedge fund stock analyst. In 2008, as part of a cooperation agreement with the Department of Justice, Tom assisted the U.S. government in understanding how insider trading occurred in the investment management industry. Tom became one of the most prolific informants in securities fraud history, helping to build over 20 of the 80+ individual criminal cases in “Operation Perfect Hedge,” a Wall Street house cleaning campaign that morphed into the largest insider trading investigation of a generation.

Tom’s a fascinating guy – he goes into his personal history and family, much deeper than he does in his corporate presentations, He’s a member of our White Collar Support Group that meets online on Monday evenings, so we know his story well. In this podcast, I think you will learn a lot about Tom – and maybe something about yourself too?

We define compassionate lawyering as giving something more than just a case solution to clients. That is, our four guests discuss putting in that extra mile to help clients find a better, more productive life during and after their issues. They share lots of stories about successes and difficulties in representing individual clients and in advocating for humanistic changes to the criminal justice system.

Corey Brinson focuses on advancing Legal Action Center’s policy advocacy priorities in New York State and plays a lead role in Legal Action Center’s criminal justice reform agenda. Before joining Legal Action Center , Corey founded the Second Chance Firm, LLC, where he serves as a criminal justice consultant, assisted people with pardons, and advocated for criminal justice reform as a lobbyist. Corey has been impacted by the criminal justice system and draws on his unique experiences to inform his work as a policy advocate. Corey has been a member of the Hartford City Council, operated a law firm where he defended 400 people in criminal matters in state and federal court and won acquittals at trial, and served in the Air National Guard and received the National Defense Service Medal for military service in Saudi Arabia on September 11, 2001. He holds a bachelor’s degree in political science from UCONN and a law degree from UCONN School of Law. He is currently a candidate for a LLM (master of laws) in Human Rights and Social Justice from UCONN School of Law. Christopher Poulos is an attorney and the Executive Director of the Washington Statewide Reentry Council. Prior to his appointment, he served as Executive Director of Life of Purpose Treatment at the University of North Texas, where he was also an Adjunct Professor of Criminal Justice. During law school, he served at the White House Office of National Drug Control Policy and The Sentencing Project. Poulos has advised United States Senator Angus King (I-Maine) on addiction and justice policy and served on several local, state, and federal taskforces related to criminal justice policy. Poulos has also taught in the Political Science Department at Seattle Central College. The United States Department Justice consulted with him as one of the nation’s most successful people following incarceration. He graduated cum laude from the University of Maine School of Law, where he was President of the American Constitution Society and represented children facing criminal charges as a student attorney in the Juvenile Justice Clinic.

Poulos is a national leader in criminal justice policy and addiction recovery. He has presented his work to diverse organizations across the United States – including state and federal prisons, jails, large nonprofits, national conferences, universities, law schools, the White House and other governmental bodies, as well as addiction recovery organizations.

Prior to law school, Poulos overcame many obstacles, including tragic family losses, addiction, homelessness, and a federal incarceration. He now dedicates his life to helping others overcome or avoid similar challenges and he supports a public health-based approach to addiction. His work promotes equal access to the law and seeks to end mass incarceration and the collateral consequences now facing the tens of millions of people with criminal convictions.

Poulos’s work and story have been featured in the New York Times, Washington Post, NBC News, Harvard Law & Policy Review, The Epoch Times, and a myriad of other national and local media outlets. He was named among “Maine’s Most Intriguing People” in Portland Magazine’s annual publication and selected as a “Law Student of the Year” by National Jurist Magazine. Bob Herbst has been trying civil and criminal cases to juries for almost 40 years. He grew up on the criminal side of the court as a federal prosecutor in Chicago and Philadelphia, where he specialized in major economic crime and public corruption cases, and as Executive Assistant District Attorney in Brooklyn, New York, where he headed the Investigative Bureaus and supervised all of that office’s investigations and prosecutions of white collar crime and official corruption. Since 1983, Mr. Herbst has been in private civil litigation and criminal defense practice, specializing, on the civil side, primarily in civil rights, employment and housing discrimination cases and class actions in the federal and state courts. He has more than 25 years’ experience representing victims of police, corrections and other municipal or state misconduct; sexual harassment and other forms of sex or gender discrimination; race, ethnic, and disability discrimination, and consumer and securities fraud. His experience also includes cases involving whistleblower-protection, malpractice, defamation, false allegations of child abuse, inadequate premises security, commercial, banking and real estate disputes, products liability, and intellectual property. Mr. Herbst has actively represented his clients in mediation and arbitration as well as in court, and often counsels employees prior to, and in an effort to avoid, litigation. He is currently Independent Counsel to the Special Court for Sierra Leone.

Mr. Herbst is a graduate of Princeton University and the Yale Law School. He has taught trial practice to law students, government and private lawyers, and federal judges. He has repeatedly been selected as one of New York’s SuperLawyers and is widely-known as one of New York City’s leading, most experienced and successful private civil rights and employment trial lawyers. He has served on the Executive Board of the New York affiliate of the National Employment Lawyers Association (NELA/NY) and the Advisory Board of NYU’s Center for Labor and Employment Law. George Hritz handles complex litigation, arbitration and other disputes and often serves as part-time general counsel for individuals and companies. He is a graduate of Princeton University, where he was a classmate of Bob Herbst, and Columbia Law School, where he was a Harlan Fiske Stone Scholar.

George clerked for a federal district judge in New York and was associated with the Cravath law firm. After and during periods of government service in Washington D.C., he was a partner at the Hogan Lovells law firm and its predecessors in New York for 30 years before starting his own practice in Connecticut and in New York, where he is also of counsel to the Westchester law firm founded by the son of the judge he clerked for at the beginning of his career.

George has published numerous articles in U.S., European, Asian and Middle Eastern journals and presented at various litigation and arbitration conferences and panels on ethical issues, electronic discovery, international arbitration, extraterritorial jurisdiction, litigation funding, legal history and U.S. anti-slavery litigation and separate settlement counsel and other dispute resolution techniques.

In addition to his law practice, George is co-founder, President Emeritus and General Counsel of Princeton in Africa, which has placed over 500 recent college and professional school graduates at more than 50 organizations in over 30 African countries in the past 20 years. He also served for over 30 years on the Board and Overseers of the International Rescue Committee, a prominent refugee relief organization and was its General Counsel.

George also served as Associate Independent Counsel in a federal grand jury investigation and lengthy trial of a former U.S. government official in Washington, D.C. and as Associate Special Counsel to a Special Inquiry of the United States Senate. He also served as the Chairman of a municipal planning board in New York, as the capital campaign co-chair for a historic Westchester church and chairman and member of co-op and condominium boards in Connecticut and Manhattan. Welcome to White Collar Week with Jeff Grant, a podcast serving the white collar justice community. It’s the isolation that destroys us. The solution is in community.

If you are interested in this podcast, then you are probably already a member of the white collar justice community – even if you don’t quite know it yet.  Our community is certainly made up of people being prosecuted, or who have already been prosecuted, for white collar crimes. But it is also made up of the spouses, children and families of those prosecuted for white collar crimes – these are the first victims of white collar crime. And the community also consists of the other victims, both direct and indirect, and those in the wider white collar ecosystem like friends, colleagues, prosecutors, defense attorneys, judges, law enforcement, academics, researchers. Investigators, mitigation experts, corrections officers, reentry professionals, mental health care professionals, drug and alcohol counselors, – and ministers, chaplains and advocates for criminal and social justice reform. The list goes on and on…

In this very eventful summer 2020, our mission is to introduce you to other members of the white collar justice community, to hear their very personal stories, and hopefully gain a broader perspective of what this is really all about. Maybe this will inspire some deeper thoughts and introspection? Maybe it will inspire some empathy and compassion for people you might otherwise resent or dismiss? And maybe it will help lift us all out of our own isolation and into community, so we can learn to live again in the sunshine of the spirit.

Along the way, I’ll share with you some of the things I’ve learned in my own journey from successful lawyer, to prescription opioid addict, white collar crime, suicide attempt, disbarment, destruction of my marriage, and the almost 14 months I served in a Federal prison. And also my recovery, love story I share with my wife Lynn Springer, after prison earning a Master of Divinity from Union Theological Seminary in NYC, pastoring in an inner city church in Bridgeport CT, and then co-founding with Lynn in Greenwich CT, Progressive Prison Ministries, the world’s first ministry serving the white collar justice community. It’s been quite a ride, but I firmly believe that the best is yet to come.

So I invite you to come along with me as we experience something new, and bold, and different this summer – a podcast that serves the entire white collar justice community. I hope you will join me.

Progressive Prison Ministries, Inc. is the world’s first ministry supporting the white collar justice community. Founded by husband and wife, Jeff Grant and Lynn Springer in Greenwich CT in 2012, we incorporated as a nonprofit in Connecticut in 2014, and received 501(c)(3) status in 2015.  Jeff has over three decades of experience in crisis management, business, law (former), reentry, recovery (clean & sober 17+ years), and executive and religious leadership. As Jeff was incarcerated for a white-collar crime he committed in 2001, he and Lynn have a first-hand perspective on the trials and tribulations that white-collar families have to endure as they navigate the criminal justice system and life beyond.

Progressive Prison Ministries, Inc. is nonsectarian, serving those of all faiths, or no faith whatsoever. To date we have helped over three hundred fifty (350) individuals, and their families, to accept responsibility for their actions and to acknowledge the pain they have caused to others.  In accordance with our commitment to restorative justice, we counsel our members to make amends as a first step in changing their lives and moving towards a new spiritual way of living centered on hope, care, compassion, tolerance, empathy and service to others. Our team has grown to over ten people, most with advanced degrees, all of whom are currently volunteering their time and resources.

Progressive Prison Ministries’ goal is to provide spiritual solutions and emotional support to those who are feeling alone, isolated, and hopeless. We have found that these individuals are suffering from a void but are stuck, and don’t know what to do about it. Our objective is to help them find a path to a healthy, spirit-filled place on the other side of what may seem like insurmountable problems. Many of those we counsel are in a place where their previous lives have come to an end due to their transgressions. In many cases their legal problems have led to divorce, estrangement from their children, families, friends and support communities, and loss of a career. The toll this takes on individuals and families is emotionally devastating. White-collar crimes are often precipitated by other issues in the offenders’ lives such as alcohol or drug abuse, and/or a physical or mental illness that lead to financial issues that overwhelms their ability to be present for themselves and their families and cause poor decision making. We recognize that life often presents us with such circumstances, sometimes which lead us to make mistakes in violation of the law.

All conversations and communications between our ordained ministry, and licensed clinical relationships, and those we serve fall under state privilege laws. This is a very special podcast – we have on 16 members of our White Collar Support Group that meets on Zoom on Monday nights, 7 pm Eastern, 4 pm Pacific. We have held over 200 weekly meetings and they get better each week as we come out of isolation and into a supportive community that truly cares about one another. We have welcomed over 200 support group members along the way!

But the support group meeting on this podcast is a little different than most, because everyone appearing has agreed to share their names, faces and very personal stories in an effort to reach out to individuals and families suffering in silence. We’ve never done anything like this before as a group, but we feel the cause is so important that it was worth the risk.

Jacqueline Polverari, MBA, MSW was a Social Worker for over 10 years and a partner in a large Title Company for over 15 years.  As an entrepreneur, Jacqueline had reached new limits of her career as an experienced professional with proven success in business and mentoring environments when a series of poor choices led her to a federal indictment and a sentence of almost a year in Danbury Federal Prison Camp for Women. After her release, Jacqueline entered a new phase of her life researching in depth about Mental Health, Crime and Criminal Justice while correlating it to reentry services.  This clearly grew into her passion after she had faced the many challenges of reentry.  It is clear to her that there is a lack of resources for reentry and there is a need for change.  She is working and advocating to be part of a change to come by dedicating herself to help fix this broken criminal justice system. Jacqueline is currently an integral part in helping women prepare for entry and reentry of the Federal Prison System both psychologically and spiritually through mental health services and education of the system.  She has founded Evolution Family Reentry Services and is currently building resources by establishing nurturing partnerships with professionals in the mental health fields as well as employers and career placement agencies to help women and their families who face career barriers as they re-enter into society.  You can reach Jacqueline at: http://www.evolutionreentry.com/.


Jeffrey Abramowitz, J.D. is the Executive Director of Reentry Services for JEVS Human Services and Program Director of Looking Forward Philadelphia. Jeff was a 2018 Fellow for Justleadership USA, and has most recently served as the Director of Student Services & Workforce Development for Community Learning Center. Jeff was a trial lawyer in Philadelphia before poor choices in life and his professional career resulted in acceptance of responsibility and a five-year sentence in the federal prison system. Entering the criminal justice system allowed Jeff the opportunity to see the world with a new pair of glasses and find his passion for education and workforce development. In the short 4.5 years since Jeff has been home he has worked with over 4,000 individuals, spoken and lectured across the country to educators, administrators, communities, and those touched by our criminal justice system. Jeff  proudly sits on the Executive Board of the Coalition on Basic Adult Education, COABE, where he serves as the chair of the Literacy Behind and Beyond the Walls Committee, was appointed to the Pennsylvania Reentry Council and serves as Chairman of the Employment Committee and Co-chairs the Reentry Committee for the PA Workforce Development Board. Jeff is active in the Philadelphia Reentry Coalition. Jeff serves on the board of directors of Community Forgiveness & Restoration, a member of NationSwell Council, and Advisory Board Member of Philadelphia Petey Greene Program. Jeff  is presently a LINCS Reviewer, Literacy Information & Communication System, Resource Collection, for the Department of Education, and serves on the National Association of State Directors of Education, Barbara Bush Foundation Criminal Justice Work Group. Jeff is the producer and host of the award-winning weekly radio show “Looking Forward” on Philly Cam Radio WPPM 106.5FM.  Jeffrey is a writer, keynote speaker and lecturer around the country on issues of adult education, workforce development and criminal justice. Joseph Grmovsek is the subject of the educational-documentary film Collared and is the first and still ONLY person in Canadian history to serve a Federal sentence of imprisonment for insider trading. He is currently the Program Director for Restorative Justice Housing Ontario, a charity that finds safe homes for elderly ex-prisoners, as well as a public speaker on issues of restorative justice and white-collar crime prevention. What is the White Collar Justice Community?

Welcome to White Collar Week with Jeff Grant, a podcast serving the white collar justice community. It’s the isolation that destroys us. The solution is in community.

If you are interested in this podcast, then you are probably already a member of the white collar justice community – even if you don’t quite know it yet.  Our community is certainly made up of people being prosecuted, or who have already been prosecuted, for white collar crimes. But it is also made up of the spouses, children and families of those prosecuted for white collar crimes – these are the first victims of white collar crime. And the community also consists of the other victims, both direct and indirect, and those in the wider white collar ecosystem like friends, colleagues, prosecutors, defense attorneys, judges, law enforcement, academics, researchers. Investigators, mitigation experts, corrections officers, reentry professionals, mental health care professionals, drug and alcohol counselors, – and ministers, chaplains and advocates for criminal and social justice reform. The list goes on and on…

Our mission is to introduce you to other members of the white collar justice community, to hear their very personal stories, and hopefully gain a broader perspective of what this is really all about. Maybe this will inspire some deeper thoughts and introspection? Maybe it will inspire some empathy and compassion for people you might otherwise resent or dismiss? And maybe it will help lift us all out of our own isolation and into community, so we can learn to live again in the sunshine of the spirit.

Along the way, I’ll share with you some of the things I’ve learned in my own journey from successful lawyer, to prescription opioid addict, white collar crime, suicide attempt, disbarment, destruction of my marriage, and the almost 14 months I served in a Federal prison. And also my recovery, love story I share with my wife Lynn Springer, after prison earning a Master of Divinity from Union Theological Seminary in NYC, pastoring in an inner city church in Bridgeport CT, and then co-founding with Lynn in Greenwich CT, Progressive Prison Ministries, the world’s first ministry serving the white collar justice community. It’s been quite a ride, but I firmly believe that the best is yet to come.

So I invite you to come along with me as we experience something new, and bold, and different – a podcast that serves the entire white collar justice community. I hope you will join me.

Progressive Prison Ministries, Inc. is the world’s first ministry supporting the white collar justice community. Founded by husband and wife, Jeff Grant and Lynn Springer in Greenwich CT in 2012, we incorporated as a nonprofit in Connecticut in 2014, and received 501(c)(3) status in 2015.  Jeff has over three decades of experience in crisis management, business, law (former), reentry, recovery (clean & sober 17+ years), and executive and religious leadership. As Jeff was incarcerated for a white-collar crime he committed in 2001, he and Lynn have a first-hand perspective on the trials and tribulations that white-collar families have to endure as they navigate the criminal justice system and life beyond.

Progressive Prison Ministries, Inc. is nonsectarian, serving those of all faiths, or no faith whatsoever. To date we have helped over three hundred fifty (350) individuals, and their families, to accept responsibility for their actions and to acknowledge the pain they have caused to others.  In accordance with our commitment to restorative justice, we counsel our members to make amends as a first step in changing their lives and moving towards a new spiritual way of living centered on hope, care, compassion, tolerance, empathy and service to others. Our team has grown to over ten people, most with advanced degrees, all of whom are currently volunteering their time and resources.

Progressive Prison Ministries’ goal is to provide spiritual solutions and emotional support to those who are feeling alone, isolated, and hopeless. We have found that these individuals are suffering from a void but are stuck, and don’t know what to do about it. Our objective is to help them find a path to a healthy, spirit-filled place on the other side of what may seem like insurmountable problems. Many of those we counsel are in a place where their previous lives have come to an end due to their transgressions. In many cases their legal problems have led to divorce, estrangement from their children, families, friends and support communities, and loss of a career. The toll this takes on individuals and families is emotionally devastating. White-collar crimes are often precipitated by other issues in the offenders’ lives such as alcohol or drug abuse, and/or a physical or mental illness that lead to financial issues that overwhelms their ability to be present for themselves and their families and cause poor decision making. We recognize that life often presents us with such circumstances, sometimes which lead us to make mistakes in violation of the law.

All conversations and communications between our ordained ministry, and licensed clinical relationships, and those we serve fall under state privilege laws. This is one reason that attorneys often allow and encourage their clients to maintain relationships with us while in active prosecution or litigation situations.I

Dear Friends:

This is an invitation to join a growing community of men and women who have faced, or are facing, prosecution for white collar crimes. 

Every Monday evening, I attend a White Collar Support Group on ZOOM. We are a very diverse group, all sharing a common bond, in varying stages of our journey. We share the good and the bad, our struggles and our successes, and what we have learned, all with a focus on compassion and accountability, in a supportive and spiritual setting.

Although the lens is spiritual, we get real in a hurry as we are all in the midst of the most difficult challenges of our lives. Most of us have lost our careers, our friends and our families, some of us were subjected to relentless press coverage, and we were all ostracized from our communities.

Rev. Jeff Grant, J.D, M.Div. mentors our group. He has traveled the road we are on. I encourage you to read Jeff’s story.

I met Jeff in 2013, a few months into dealing with a federal indictment for wire fraud. I was confused at what I was facing, and scared at the thought of what this would do to my family, especially my youngest children who were 9 and 11 years old at the time. My children were soon likely to lose both their parents to federal prison. 

The first time Jeff and I spoke, I had just dropped off the kids at school and was sitting in my car in the Wal-Mart parking lot where I wouldn’t be disturbed. Jeff answered my call and I nervously introduced myself. I realized fairly quickly that Jeff was someone who could help me find some of the answers I was seeking. We talked for at least 90 minutes that morning.

Whether it was discussing how best to talk to the children about our situation; setting up a support system for them in school and in private counseling; talking thru the various aspects of dealing with the criminal justice system and what to expect before, during and after; never once did he rush me off or make me feel that my issues were unimportant. Jeff has helped me in so many ways since that first call. In fact, it was Jeff who suggested that my attorney request staggered sentences for my wife and me (which the judge approved).

Since that first call we’ve talked about life in prison and starting over afterwards, maintaining a marriage while incarcerated, and the importance of forgiveness, just to name a few. I value Jeff’s advice because he always gives a straight answer and I can always count on it being true to his experience.

Eventually, in 2015, I was sentenced to 24 months in federal prison. My report date was deferred until 2019, while my wife served her time. This time was invaluable; as I was able to raise my children from early childhood to the wonderful teenagers they are today. The most difficult thing I ever faced was saying goodbye to my children and family and walking into R&D at El Reno. Even as I took those steps, and began serving my sentence, Jeff and his ministry were there for me.

Six weeks ago, a little over one year into my sentence, I gained early release as a result of the CARES Act. I’m back home in Tulsa now, living with my children and loving every moment. That’s not to say I don’t face significant challenges. We all do. I am rebuilding extended family relationships, kick-starting a second career, adjusting to the social stigma of being a convicted felon, and doing what I can to reestablish ties to my community.

I was eager to rejoin Jeff and the support group that he has built. After clearing participation with my P.O., I was on the ZOOM call the very next Monday evening. Each week I am reminded that I am not alone, that through my participation I can help, and learn, from others, and that despite all the hardships I have so much to be grateful for.

“The new year promises to be an interesting one in white-collar crime” wrote professor Peter Henning of Wayne State University Law School and author of New York Times DealBook’s “White Collar Watch” back in January. Little did the professor know.

I doubt Henning could have predicted that thousands, maybe millions, of floundering businesses would be leaving as much as $100 billion in forgivable loans on the table as they risked insolvency because they were afraid they’d get arrested for taking it. The reopening of the economy is being slowed not just by the virus but because the public is increasingly aware of the government’s capriciousness in criminally charging people.

On May 5, two men in New England became the first people to face a criminal fraud complaint related to the Paycheck Protection Program, the $660 billion plank of the CARES Act that supplements the income of small businesses whose revenue’s been sliced by social distance and shelter-at-home orders. Prosecutors warned: More cases would be filed.

And they were. A cast member of reality TV show “Love and Hip Hop: Atlanta” was charged with making a fraudulent loan application that netted him $2 million, which he spent, in part, on a Rolex, diamonds and child support arrearage.

FBI agents picked up Maurice “Arkansas Mo” Fayne May 13, the same day the Small Business Administration changed the game and announced – in the form of guidance on Question 46 of its Frequently Asked Questions – that it would allow “safe harbor” for any loans under $2 million by assuming that all certifications made about need, meaning those statements applicants make about how much the business required the stimulus loan to stay afloat, were made in good faith.

That’s code for “no criminal charges.” If those PPP loans aren’t used for payroll and overhead, they’ll have to be paid back, but companies that borrowed less than $2 million shouldn’t expect to look out the window and see windbreakers on the stoop.

That also means that if Arkansas Mo had sought and borrowed $1.9 million and hadn’t been found out before May 13, he could have tooled around in his leased 2019 Rolls-Royce Wraith without worrying about red and blue lights pulling up on him.

The average loan is around $240,000, so it stands to reason that many, maybe even a majority, of PPP borrowers are covered by the guidance in Question 46 and won’t become defendants in criminal cases related to the PPP. Among those who’ve been preemptively absolved, there must be a few who fudged the numbers or doctored a document. At least for now, it looks like they’ll get away with it. While collar crime is interesting, indeed.

Attracting my attention is the likely reason for the SBA rule change. The deadline for the original PPP safe harbor provision – the amnesty period for borrowers who had committed fraud in the PPP application process to return the money in any amount with no questions asked – was May 14, a day after the answer to Question 46 appeared.

Business owners had been described as panicked and anxious prior to the May 14. Confessing to a crime when no penalty awaits is easy; the fact that entrepreneurs were perplexed about whether they should return the money during a time of financial amnesty tells me that they likely hadn’t made phony applications but were more afraid that the government would accuse them of doing so even if they hadn’t.

While the number of returned loans hasn’t been reported as of May 15, I bet it was higher than anticipated – almost like a reverse bank run – because people didn’t want to risk an indictment by an unpredictable prosecutorial regime. The SBA changed the safe harbor rule on May 13 because appropriated funds need to be circulating in the economy, otherwise foil the point of the PPP.

Especially during a crisis, no one should take advantage of stimulus programs or other bailouts. Some will, out of greed or even desperation, as the Rev. Jeff Grant, former inmate and founder of Progressive Prison Ministries, described in a first-person column for Entrepreneur.com. But most won’t, and they should feel confident that their lack of intent to cheat the government would protect them from being criminally accused as they’re trying to save their business against unprecedented odds.

But lack of intent – it’s called mens rea, Latin for “guilty mind” – is rarely a protection against indictment. White-collar crime in the year 2020 is interesting because people are proving that they’re hip to this reality; they wisely gave wide berth to fickle federal prosecutors, proving they’d go under before they’d go up the river over some poorly outlined lending rules.
